Under Article 22.2 of Spanish Law 34/2002 of 11 July on Information Society Services and Electronic Commerce.
This page is a translation offered for convenience. The Spanish version is the binding one.
1. Purpose and legal framework
Article 22.2 of Spanish Law 34/2002 of 11 July on Information Society Services and Electronic Commerce (hereinafter, the “LSSI-CE”), which transposes Directive 2002/58/EC concerning privacy and electronic communications, requires the recipient’s consent in order to “use data storage and retrieval devices on recipients’ terminal equipment”. It is that operation, the storing or the retrieving, that gives rise to the obligation. The mere provision of an information society service does not.
The website grasshopperairmobility.com (hereinafter, the “Website”) carries out neither operation. It sets no cookies of its own, it loads no third-party cookies, and it writes nothing to the local storage, the session storage or the database of the User’s browser. The circumstances contemplated in the provision cited above not being present, no consent is obtained and no notice to that effect is displayed. A notice seeking consent for cookies that are not used would constitute an inaccurate statement.
2. Browser configuration
Independently of the foregoing, the User may configure the browser so as to prevent cookies from being installed, to be warned before they are installed, or to delete those already stored. The procedure varies by browser and is described in each provider’s help pages:
Disabling cookies in the browser does not affect the operation of the Website, since the Website uses none.
3. Elements loaded from outside the Website’s own domain
The hosting provider, Cloudflare, records the technical details of each request, namely the User’s IP address, the date and time, the page requested and the browser type, in its server logs. This is an operation necessary in order to deliver the Website and to protect it against attack. That record is created on the server and not on the User’s device, and therefore falls outside the scope of Article 22.2 of the LSSI-CE. Data protection law does apply, and the processing is set out in the Privacy Policy.
The typefaces and images used by the Website are served from its own domain. One script is not: Cloudflare Web Analytics, which loads from Cloudflare and counts page views. It operates without cookies. It sets no cookie, it writes nothing to the User’s device and reads nothing already stored on it, and it assigns no identifier, so it cannot recognise the User on a later visit. It reports the page viewed, the referring page, the country, the browser and device class, and the page load time. Since nothing is stored on or read from the device, it requires neither consent nor prior notice. The Website carries no Google Fonts, no advertising network and no tracking pixel.
4. Video hosted on YouTube
The home page incorporates a video hosted on YouTube. That video does not load together with the page. What is displayed initially is a still image stored on the Website’s own server, with a play button superimposed on it.
If the User presses that button, and only in that case, the video is requested from YouTube and, at that moment, YouTube (Google Ireland Limited) may store information on the device and receive the IP address. That processing is carried out by YouTube, subject to Google’s own privacy policy, and not by the Owner. The address youtube-nocookie.com is used, which reduces what is set, and the referrer information transmitted is restricted.
The video is the only element of the Website capable of placing information on the User’s device, and it does so solely at the User’s instigation. If the User does not press the play button, no communication with YouTube takes place.
5. Amendments to this policy
Should the Website come to use cookies, this policy will be amended before such use begins. Where consent is required it will be obtained in due form, with acceptance and refusal equally accessible, in accordance with the criteria of the Spanish Data Protection Agency.
Enquiries concerning this policy may be addressed to dataprotection@grasshopperairmobility.com.
